How far back can the CDTFA audit?
The standard statute of limitations is 3 years from the later of the return due date or the filing date. However, if the CDTFA determines you underreported by 25% or more, they can go back 8 years. If no return was filed, there is no statute of limitations.
What is a sampling methodology?
When a business has too many transactions to audit individually, the CDTFA will select a sample period and extrapolate the results across the entire audit period. This methodology can dramatically amplify errors — a small mistake in the sample can result in a massive assessment.
Can I dispute the CDTFA’s assessment?
Yes. You can file a Petition for Redetermination within 30 days of the Notice of Determination. This initiates a formal review process. If the petition is denied, you can appeal to the Office of Tax Appeals. Having experienced representation significantly improves outcomes at every stage.
What happens if I can’t pay the assessment?
The CDTFA offers installment payment agreements and, in limited circumstances, Offers in Compromise. However, they also have aggressive collection tools — including liens, levies, and personal liability for corporate officers. Getting ahead of collections is critical.
